Who gets the dog>??

Ok, this is going to sound really weird but my sister and her ex-boyfriend had this dog together, Lily. My sister was the one who found her and brought her home. She was living with her boyfriend at the time and they lived together for the last 3 years (with the dog). He recently found another women and kicked her out of the apartment they were sharing. Well he kept the dog and won%26#039;t let her see the dog or take the dog home with her. What rights does she have? Can she do anything to get the dog back? I know it%26#039;s %26quot;just a dog%26quot; but she loves her and wants to take her home. We thought about just going over there and taking Lily but she%26#039;s afriad he could call the cops or something. Does anyone know anyway we can get her dog back?

Does she have anything that proves the dog is hers? Records from the vet showing she%26#039;s the owner? County or City dog license with her listed as owner? If she does, she can take him to small claims court and try and recover the dog. Just be aware he may do something like try and give the dog away or take it to a shelter out of spite if she tries.
Reply:I heard and seen on TV people going to court to get custody over their animals. It depends on what state she lives in the laws are different. She can go on the Internet and pull up info. She can also contact an animal shelter and they can give her some advice also.
Reply:Does your sister have any proof that the dog is hers. I mean like vet bills, receipts, or the like? If she has proof that the dog is hers than she should go get the dog and the cops shouldn%26#039;t be able to do anything to stop her.

Reply:Sounds like a sticky issue. Like a kid. I am not sure if you want to go to court over the whole thing, but maybe just find a lawyer that can write a threatening letter to him. My other thought is that there are tons of other GREAT dogs that need homes in the local shelters. B/c getting this one back could end up costing you a lot of $$ in the end.
Reply:If the dog is hers, there is no reason to be afraid of the %26quot;cops or something.%26quot; In fact, she can call the police, explain the situation--that the dog is hers and her ex-boyfriend won%26#039;t let her have it--and a sympathetic policeman might just escort her to pick up the pup. Otherwise, she can sue in Small Claims court (usually under the Magistrate court in most places, but you can call the county courthouse and ask for the Small Claims clerk and find out.) It only costs about $25-$35 to file the paperwork, which she can fill out herself and no lawyers are involved in Small Claims, so it%26#039;s a cheap way to get a hearing before a judge. If she wins, she can get the cost of filing the court papers paid by her ex--just include it under the section where it says to describe your complaint--ex-boyfriend illegally confiscated her dog and she wants dog returned and ex to pay all court costs. Tell her good luck for me.
Reply:If she has anything to prove the dog is hers, vet papers, tags, microchipped she could call the police and report that he is holding property that is hers. In most states, animals are just considered property, so therefore the dog could be considered stolen property if she can prove it is hers.
Reply:well if she found the dog, it technically does belong to her. i would tell the guy and try to get the dog back. if that doesn%26#039;t work, i would get a lawyer to help. i hope she gets her doggy back!
Reply:If she has something to prove the dog is hers then yes all she would need is a paper from the vet with only her name on it. Or if she got the dog from a shelter they would have records of the adoption. Good Luck I hope she gets her dog. The ex sounds like an ***.
Reply:Did your sister buy the dog? Does she have proof she bought it? Sadly if she does not possession is 9/10 of the law. Unless she can prove it%26#039;s hers he%26#039;s more likely to get to keep it as it%26#039;s living in his home.
